Subject to these Terms, DiPhyx Inc. grants you a non-exclusive, non-transferable license to use dxflow Engine in accordance with its open-source license. The Software is provided under an open-source license that permits:

As dxflow Engine is self-hosted software, you are solely responsible for:

DiPhyx Inc. does not collect, store, or process your data when you use dxflow Engine. All data processing occurs within your own infrastructure. You are responsible for:
  • Implementing appropriate data protection measures
  • Securing authentication credentials and encryption keys
  • Compliance with applicable privacy laws (GDPR, CCPA, etc.)
  • Data retention and deletion policies
  • Access controls and audit logging
  • Incident response and breach notification procedures

5. Prohibited Uses

You agree not to use dxflow Engine for:
  • Illegal activities or violation of applicable laws
  • Unauthorized access to systems or networks
  • Distribution of malware, viruses, or harmful code
  • Cryptocurrency mining without proper authorization
  • Overloading or disrupting network infrastructure
  • Violation of intellectual property rights
  • Activities that could harm DiPhyx Inc. or its reputation

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DIPHYX INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Intellectual Property

dxflow Engine and its documentation are owned by DiPhyx Inc. and protected by copyright and other intellectual property laws. The open-source license grants you specific rights to use, modify, and distribute the Software, but does not transfer ownership of any intellectual property rights.

9. Termination

These Terms remain in effect until terminated. You may terminate your use of the Software at any time by uninstalling it from your systems. DiPhyx Inc. may terminate these Terms if you breach any provision. Upon termination, you must cease all use of the Software and destroy all copies in your possession.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction where DiPhyx Inc. is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

11. Changes to Terms

DiPhyx Inc. reserves the right to modify these Terms at any time. We will provide notice of material changes through our official channels. Continued use of the Software after changes constitutes acceptance of the updated Terms.
